This Privacy Policy (“Policy”) is provided by Sayva Solutions (“Sayva,” “us”, “we,” or “our”), to explain what Personal Information we collect, why we collect it, how we use and share it, and the rights you have relating to your Personal Information. This Policy applies to information we may collect from you or that you may provide when you use our websites and services (collectively, our “Services”), and to other information we may collect online or offline.

Please read this Policy carefully before using our Services. If you do not agree with this Policy, please do not use our Services. By using our Services, you agree to this Policy.

This Policy also does not cover Personal Information that may be collected about you as an applicant for a job at Sayva or for Sayva’s workforce personnel. As used in this Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a consumer or household. Personal Information does not include information that is publicly available, de-identified, or aggregated, or certain additional categories of information subject to other laws and regulations.  

Unless otherwise noted, this Policy applies to our activities in the twelve (12) months preceding the Last Updated date, as well as our current practices.

  • Personal Information Collected

Generally, we may collect the following categories of Personal Information, which we use for the business or commercial purpose shown. We may collect several types of Personal Information from those who interact with us, depending on the context of the interaction.

We may also collect, use, and disclose Personal Information as required by law, regulation, or court order; to respond to governmental and/or law enforcement requests; to identify, contact, or bring legal action against someone who may be causing injury to or interfering with our or others’ rights or property; to support any actual or threatened claim, defense, or declaration in a case or before any jurisdictional and/or administrative authority, arbitration, or mediation panel; or for other purposes described in any other privacy notice or with your consent. Additionally, we may use and disclose Personal Information to third parties in connection with a sale, assignment, merger, reorganization, or other corporate transaction relating to all or part of our business.

  • Sources of Personal Information

We may collect the categories of Personal Information described above from the following categories of sources:

  • Directly from you. For example, if you submit information through a webform or during a customer service interaction.
  • Created by us. For example, inferences about you.
  • Automatically. For example, we may collect usage data and analytics when you use our Services.
  • From service providers that help us run our business. For example, from information technology vendors, advertising providers, and other vendors.
  • From other sources. For example, from clients, educational institutions, professional organizations, and other parties that may provide us with information.
  • Disclosures of Personal Information

We may disclose each of the categories of Personal Information we collect to our service providers and contractors for the following business purposes:

  • To process your transactions or requests for products or Services.
  • To provide Services (including processing, maintaining, or collecting Personal Information) on our behalf (e.g., fulfilling orders, processing payments, supporting our promotions, providing communications, technical, analytical, web hosting, cloud hosting and application support, or other services on our behalf).
  • Auditing related to ad impressions.
  • To ensure security and integrity of Personal Information.
  • To debug or identify and repair errors that impair existing intended functionality.
  • For short-term, transient use, including, but not limited to, non-personalized advertising.
  • To provide advertising and marketing services.
  • To undertake activities to verify or maintain the quality or safety of our Services.
  • To comply with applicable laws and regulations.
  • To detect or protect against malicious, deceptive, fraudulent, or illegal activity.
  • How Long We Keep Personal Information

We keep the categories of Personal Information described above for as long as necessary or permitted for the purposes described in this Policy or otherwise authorized by law. This generally means retaining the information for as long as one of the following apply: 

  • The Personal Information is reasonably necessary to manage operations, to manage your relationship with us, or to satisfy another purpose for which we collected the Personal Information;
  • The Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was collected; 
  • The Personal Information is reasonably necessary to protect or defend our rights or property (which will generally relate to applicable laws that limit actions in a particular case); or 
  • We are otherwise required or permitted to keep Personal Information by applicable laws or regulations. 

Where Personal Information is used for more than one purpose, we will retain it until the purpose with the latest period expires. 

  • Tracking Technologies and Cookies

We may use cookies and similar tracking technologies, including pixels, web beacons, and scripts, to track the activity on our Services and collect certain information, including your interactions with our websites and your browsing behavior. Our websites may also support third-party tracking technologies.

In general, our website may use cookies and other tracking technologies as follows:

  • Where necessary to run our websites.
  • For analytics purposes—for example, to help understand how our websites are used.
  • To optimize the functionality of our websites, including by personalizing content and remembering user preferences. 
  • To determine if email messages have been opened and acted upon. 

Cookies vary in how long they last. “Session cookies” terminate shortly after terminating an internet session. “Persistent cookies” are stored on the device used until a set expiration date. We may use both session cookies and persistent cookies on our websites.

  • Website Analytics

We may use Google Analytics or other service providers for analytics services. Analytics tools in use on our website may collect the following types of information, among others: IP address; screen size; device type (unique device identifiers); browser information; geographic location; and preferred language.   • Do Not Track Signals

Our websites automatically respond to and honor “Do Not Track” (DNT) signals sent by web browsers, mobile devices, or other mechanisms.

  • Sales and Sharing of Personal Information

We do not “sell” or “share” Personal Information as those terms are defined under applicable law.

  • Third-Party Sites and Services

The Services may contain links to other websites (“Linked Sites”). Sayva is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by us of the site or any association with its operators. Sayva does not control nor take responsibility for the content of any Linked Sites, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site.

  • Third-Party Accounts

You may be able to connect your Sayva account to third-party accounts, e.g., your Facebook, X, Instagram, or LinkedIn account. By connecting your Sayva account to any third-party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third-party sites). If you do not want information about you to be shared in this manner, do not use this feature.

  • International Users

Our Services are directed solely to residents of the United States. If you access our Services from outside of the U.S., please be aware that Personal Information collected through the Services may be transferred to, processed, stored, and used in the U.S. Data protection laws in the U.S. may be different from those of your country of residence. Your use of the Services or provision of any Personal Information to us constitutes your consent to the transfer to and from, processing, usage, sharing, and storage of your information in the U.S. as set forth in this Policy.

  • Security of Your Personal Data

The security of your Personal Information is important to us but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.

  • Email Marketing

We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you, consistent with the disclosures in this Policy. You may opt-out of receiving any, or all, of these communications by following the unsubscribe link or instructions provided in any email we send or by contacting us as provided below.

  • California Privacy Rights

The California Consumer Protection Act, as amended (the “CCPA”) provides California residents with specific rights regarding their Personal Information. If you are a resident of California, you have the following rights:

  • The right to know.  You have the right to request more information regarding the following:
    • The categories of Personal Information we collected about you, including:
      • The categories of sources for the Personal Information we collected about you
      • Our business or commercial purpose for collecting, selling, or sharing that Personal Information
      • The categories of Personal Information that we sold or disclosed for a business purpose, and for each category identified, the categories of recipients to which we disclosed that particular category of Personal Information
    • The specific pieces of Personal Information we collected about you
  • The right to delete. You have the right to request the deletion of your Personal Information, subject to certain exceptions. Where we use deidentification to satisfy a deletion request, we commit to maintaining and using the information in deidentified form and will not attempt to reidentify the information.
  • The right to correct. If you believe that Personal Information we maintain about you is inaccurate, you may submit a request for us to correct that information. Upon receipt of a verifiable request to correct inaccurate Personal Information, we will use commercially reasonable efforts to correct the information as you direct. 
  • The right to opt out of sales and sharing of Personal Information. We do not sell or share Personal Information for purposes to which the right to opt out of sales and sharing applies under the CCPA.
  • The right to limit use and disclosure of sensitive Personal Information. We do not use or disclose sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the CCPA.
  • The right not to be discriminated against. You have the right not to be discriminated against for exercising any of your consumer rights.

Please note that if you submit a request, you will be asked to provide 2-3 pieces of Personal Information that we will match against our records to verify your identity. You may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed. An authorized agent may submit a request on your behalf using the methods described above.

California Shine the Light: We do not share Personal Information with third parties or affiliates for those third parties’ or affiliates’ own direct marketing purposes. Please note that we are only required to respond to one request per customer each year. Because these rights and your CCPA rights are not the same and exist under different laws, you must exercise your rights under each law separately.

  • Other State Privacy Rights

This section provides information for residents of certain States that provide privacy rights to their residents (each, a “Covered State”). If you a resident of a Covered State, you may have the right to submit certain requests relating to your Personal Information (or “Personal Data,” as applicable), as described below.

  • Sales of Personal Data. We do not sell your Personal Data. 

Making a Privacy Rights Request

If you are a resident of a Covered State, you have the right to submit certain requests relating to your Personal Data as described below. To exercise any of these rights, please submit a request by emailing us at sayva@sayvasolutions.com or calling us toll-free at 800-548-3466. Please note that we will need to authenticate your identity before your request can be processed. For authentication, you will be asked to provide 2-3 pieces of Personal Data that we will match against our records. 

  • Right to Access and Data Portability. You have the right to confirm whether we are processing your Personal Data, to access your Personal Data, and to obtain a copy of Personal Data you provided to us in a portable format. 
  • Right to Correct. You have the right to request that we correct inaccuracies in your Personal Data, taking into account the nature of the Personal Data and our purposes for processing it. 
  • Right to Delete. You have the right to request that we delete your Personal Data, subject to exceptions.
  • Right to Opt-Out. You have the right to opt out of the following uses of your Personal Data: (a) targeted advertising; (b) the sale of Personal Data; and (c) profiling in furtherance of decisions that produce legal or similarly significant effects, if applicable.  
  • Right to Appeal. Sometimes we are unable to process requests relating to your Personal Data, in which case, your request will be denied. If you are a resident of a Covered State whose privacy rights request has previously been denied by us and you believe we denied it in error, you may appeal for reconsideration of your request by contacting us as provided below.

Please note that if you make a privacy rights request, we will retain the Personal Data submitted in connection with your request for recordkeeping purposes.

  • Children’s Privacy

Our Services do not target anyone under the age of 16. We do not knowingly collect Personal Information from anyone under the age of 16. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from anyone under the age of 16 without verification of parental consent, we will take steps to remove that information from our servers.

  • Changes to this Privacy Policy

We may update our Policy from time to time. All changes will be effective immediately upon posting. Each version of our Policy will be prominently marked with a Last Updated date. Your continued use of our Services after the effective date of this Policy indicates your agreement to the terms hereof. If you disagree with any of the terms, please do not use our Services.
